If you continue to browse and use our website, or purchase any goods or service’s you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Perfect Fabrications limited relationship with you in 

relation to this website and our company. If you disagree with any part of these terms and 

conditions, please do not use our website, produces or services. 

2. Definitions 

The following definitions will be used and apply to this contract. 

(You, yours, buyer or user) will mean the person, company or user of the website 

(Our, us, we or perfect fabrications) will mean Perfect Fabrications Limited 

(Contract) will mean the contract between perfect fabrications and you for the supply and/or installation of any of our products 

(Made to order, bespoke) will mean products made specifically for you in the size/material/ colour of your choice upon receipt of your order. 

(good(s), product(s)) will mean any goods sold by us digital or physical to you under this contract 

(system(s)) will mean any extraction and/ or ventilation system including but not limited to canopies, fans, ducting, odour control systems. 

(premises) will mean any address that good(s) are to be installed 

(site) will mean the website of perfect fabrications 

(sub contractors) 

(bespoke systems) will mean any extraction and/ or ventilation system including but not limited to canopies, fans, ducting, odour control systems 

(we) 

3. Agreement 

3.1  By purchasing any products digital or physical from us or on our site you agree to be legally bound to this contract.

3.2 No variations of the contract will be valid without prior written conformation from us. 

3.3 Any guidance or recommendations provided by us regarding good(s) product(s) or system(s) must be confirmed by us in writing, if no confirmation            by writing has been made you act entirely at your own risk, we will not accept any liability for the guidance or recommendations

3.4 Orders are only accepted by us upon receiving an order confirmation email from us

3.5 Upon receiving an order confirmation email from us your contract with us will start

4. terms of payments & charges

Customers without a credit account

4.1. Full payment will be required before your order can be placed for all good(s) product(s) and system(s)

4.2. For all bespoke system(s) a 60% deposit is required prior to us confirming your order and a further 40% will be due before work commences on the           day we have agreed with you to start the installation process unless agreed otherwise by us in writing. Failure to make the second payment may                   result in extra charges see clause …. 10.8 

Customers with a credit account

4.3. We will invoice you for the good(s) product(s) or system(s) when they are ready for delivery or collection this includes part of an order where                        appropriate

4.4. We may require a deposit before work can commence on your order

4.5. We reserve the right to charge you extra in cases where your requirements change at our hourly rate and to charge for extra materials along with our          standard mark up

4.6. We reserve the right to cancel customers credit accounts at any time

4.7. Credit accounts are available entirely at our own discretion

All customers 

4.8. We reserve the right to change our initial price at any time if this contract is broken by you causing us significant increase in labour costs, materials costs or any other type of costs

4.9. Interest on Late commercial payments will incur 8% plus the bank of England base rate calculated on a daily basis

5. Payment methods 

5.1. We accept bacs, Debit/ Credit cards we do not accept cheques.

All business card payments will be subject to a handling fee of 1.5% 

6. Title 

6.1. Title to the goods dose not pass to you until you have paid the full price of those good(s) product(s) system(s) or bespoke system(s) this is still the               case if they have been passed to a third party or incorporated into an assembly.

6.2. You will hold the good(s) in safe storage as bailee and fiduciary agent separate from other goods so they can be easily identified for us where you               grant us access to your property or third-party properties to re-possess good(s) not paid for

6.3. Until the title has passed to you we will be entitled at any time to enter any of your property’s or any third party property to re-posses the goods
 

7. Risk

7.1. The risk of damage, loss or theft of the good(s) will pass to you upon successful delivery to the address provided by you

7.2. Upon delivery It is up to you to ensure the goods are insured and well protected from any risks

7.3. We will not be liable in any way for your failure to take delivery

8. Your obligations
 

8.1. Ensure all relevant party’s are aware of works being undertaken and all approvals, licences, permits and planning permissions have been obtained by           you at your own expense.

8.2. Ensure all working areas that we may need to access are easily accessible clean and non-hazardous

8.3. Ensure we have access to all parts of the property we may need to carry out our works
 

8.4. Put in place any scaffolding where working at height is necessary.
       Ensure we are made aware of any asbestos at the premises prior to our arrival 

       Ensure there is water and electric on site, if none is available, you must notify us by writing as soon as you become aware

8.5. Not to use the system before we have confirmed it is safe to do so in writing
 

8.6. Not make any changes repairs or modifications without our prior consent in writing.

8.7. To ensure you have checked and made us aware of any hidden electrical cables gas pipes water pipes and any other wiring or piping that may affect           the installation of equipment

8.8. Ensure the electrical supply is sufficient and compatible with all equipment to be installed

8.9. Ensure you check the ducting system once a month and employ a specialised duct cleaning company to clean ducting on a regular basis
 

8.10. To never allow unreasonable grease, oil and fat build up in the ducting system 

8.11. Pay for any re decoration and restoration required to the premisses as a result of installing the system(s)
 

8.12. Pay for any additional works you may require outside the scope agreed 

8.13. Check the scope of work that we have agreed to ensure it is correct and to your expectations before you enter this contract 

8.14. To ensure all your obligations are met

8.15. To check any products you purchase from us are suitable for your needs 

8.16. To understand that products made to order / bespoke cannot be refunded 

9. Our obligations 

9.1. To ensure all product supplied and installed are of a reasonable quality and above all work to a high standard.

9.2. We will aim to complete the installation on time, however in the case that there are delays to the installation we will not be liable to any penalties
 

10. Delivery 

10.1. Once your order has been completed we will contact you via email or phone to arrange a date to deliver your order unless otherwise stated in writing          to any UK mainland address.

10.2. We will aim to meet the delivery date however if the delivery date is not met you have no right to cancel the order, to refuse payment or to any                       compensation for late delivery. 

10.3. We are entitled to the price of the goods when ready for delivery 

10.4. As our canopies are made to order delivery times are generally between 7 days to 21 days 

10.5. All other goods sold on our website will be delivered between 7 days to 21 days. 

10.6. All delivery’s larger than a standard euro pallet will be curb side delivery meaning it will be left at the road side or the easiest convenient place for the           delivery driver to drop off. 

10.7. Any damages must be reported to us within 48 hours of receiving your good(s) failure to report damages to us within this time frame will mean we              will not be liable for any damages 

10.8. If you refuse, put off or for any reason outside of our control the delivery has failed we can charge you for redelivery, and storage of your goods at               our property

10.9. After one month of non-collection, we are entitled to dispose of the good(s) 

10.10. Some larger good(s) may require you to have suitable means of offloading the delivery vehicle, failure to provide suitable means may result in re-                delivery and therefore be subject to an additional charge

10.11. Re delivery charges will need to be paid in advance. 

11.    Refunds/ Returns 

11.1. Any orders placed where goods(s) are made to order or bespoke cannot be refunded and are not subject to the 14 day cooling off period. 

11.2. Made to order/ bespoke returns will only be accepted if the item is damaged or faulty. 

11.3. In the case of faulty or damaged items we will repair, replace or refund the item as we see fit. 

11.4. Stock items are subject to the 14 day cooling off period.
